Aggravated Assault with a Deadly Weapon — Charge Reduced
Case Description
Our client found himself in deep trouble, facing serious accusations of threatening his wife with a gun and repeatedly strangling her during an assault. Investigators soon uncoveredt hat this was not the first time he had assaulted her, and he was faced with multiple felonies. Even though the charges were grim, we knew there was more to his story — our client had been through severe trauma and struggled with drug abuse for years.
Legal Strategy
We worked tirelessly to humanize our client, showcasing his past traumas and ongoing battles with addiction. We were in the middle of negotiating a plea deal that would have landed him probation, but then things took a turn — he made consensual contact with the complainant, breaking the protective order and putting the deal in jeopardy.
Challenges
The violation of the protective order was a major setback, especially since it could have derailed everything. The initial 16-year sentence was a heavy weight hanging over our client's head, and we had to act fast to minimize the damage.
Resolution
Despite the complications, we kept pushing and managed to negotiate the sentence down from 16 years to 8, and eventually to just 2 years in TDCJ. It wasn’t an easy road, but in the end, our client avoided the worst possible outcome and got a chance to start fresh after serving his time.
